Terms and Conditions – Koen’s Fine Art

Article 1 – Identity of the Seller

Article 2 – Applicability

1. These terms and conditions apply to every offer made by the seller and to every distance contract concluded between the seller and the consumer through the webshop.

2. Prior to the conclusion of a distance contract, the text of these terms and conditions shall be made available to the consumer in a way that enables easy storage and reproduction.

Article 3 – The Offer

1. The offer contains a complete and accurate description of the products being offered. The description is sufficiently detailed to enable the consumer to assess the offer properly.

2. Obvious errors or mistakes in the offer are not binding on the seller.

3. Each offer clearly indicates the consumer’s rights and obligations associated with acceptance of the offer.

Article 4 – The Contract

1. The contract is concluded when the consumer accepts the offer and meets all specified conditions.

2. If the consumer accepts the offer electronically, Koen’s Fine Art will confirm receipt of the order without delay via email.

3. Koen’s Fine Art takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe webshop environment.

Article 5 – Right of Withdrawal

1. The consumer has the right to withdraw from the contract within 14 calendar days of receiving the product, without giving any reason.

2. To exercise this right, the consumer must notify Koen’s Fine Art by email (info@koensfineart.be) using an unambiguous statement.

3. The consumer must return the product within 14 days of notifying the withdrawal. Return shipping costs are the responsibility of the consumer.

4. Koen’s Fine Art will refund the full purchase amount, including standard delivery charges, within 14 days after receiving the returned product in original condition.

Exceptions:
The right of withdrawal does not apply to artwork that is custom-made or personalized for the customer.

Article 6 – Prices

1. All prices on the webshop include VAT (where applicable) and other government-imposed levies.

2. Any additional delivery or packaging charges will be clearly stated prior to order confirmation.

Article 7 – Payment

1. Payments must be made using the available payment methods during the checkout process.

2. In the event of non-payment or delayed payment, Koen’s Fine Art reserves the right to suspend or cancel the order.

Article 8 – Delivery and Performance

1. Koen’s Fine Art takes the utmost care in processing and delivering orders.

2. Products are delivered to the shipping address provided by the consumer during checkout.

3. Unless otherwise agreed, orders will be delivered within 30 days.

4. Any delivery delays will be communicated as soon as possible.

Article 9 – Warranty and Conformity

1. Koen’s Fine Art guarantees that the products conform to the contract, the stated specifications, and general standards of quality and craftsmanship.

2. Transport damage must be reported within 48 hours of delivery. In such cases, Koen’s Fine Art will work with the consumer to resolve the issue promptly.

Article 10 – Complaints

1. Complaints must be submitted by email to info@koensfineart.be within 7 days of identifying a problem, with a clear description of the issue.

2. Koen’s Fine Art will respond to the complaint within 14 days of receipt.

Article 11 – Governing Law and Disputes

1. These terms and conditions are governed by Belgian law.

2. Disputes shall be submitted to the competent court in the district of the seller’s registered office, unless otherwise required by mandatory consumer protection law.
